Challenging provision

Harvey was born prematurely and it was not certain that he would live. Like many other children, the extent of his disabilities has emerged as time has passed.

Where individuals wish to dispute the decisions of public bodies, Parliament has established a Tribunals Service.

Where educational issues to be resolved relate to a local authority decision about a child's/young person’s statutory special educational assessment, plan or related provision or to discrimination relating to a pupil’s disabilities, the relevant service is the First-tier Tribunal (Special Educational Needs and Disability).

Parents of children/young people (over 16 years of age) with Education Health and Care (EHC) Plans who wish to make an appeal to this tribunal, will be invited to consider mediation first.
